Fun Supply Terms & Conditions / Assumption of Risk
Assumption of Risk: You acknowledge that all water sports (e.g. kitesurfing, hydrofoiling, wing foiling, paddleboarding, kayaking, surfing, etc.) involve inherent risks, including injury or death, that cannot be fully eliminated, even with caution or expertise.
Responsibility for Risks: You voluntarily assume all risks, including injury or death, whether caused by negligence or not, and acknowledge dangers such as wildlife (e.g. crocodiles, sharks, jellyfish).
Alcohol/Drugs: You agree not to use alcohol or drugs before or during water activities.
Swimming Ability: You confirm that you can swim in open ocean conditions for 1km and tread water for 2 minutes.
Health Condition: You confirm you have no medical conditions that could be aggravated by these activities.
Release of Liability: By booking, paying for, hiring equipment, or participating in any activity, you release Geoff James, Fun Supply, its employees, and agents from any liability for injury or death, to the maximum extent permitted by law.
Medical Treatment: You authorise Fun Supply to arrange necessary medical treatment and agree to cover any associated costs.
Equipment Responsibility: You accept responsibility for any damage to equipment provided to you, other than normal wear and tear.
Acknowledgement: By booking, paying for, hiring equipment, or participating in any activity, you acknowledge that you have read and understood these Terms & Conditions and acknowledge them as a release of liability and assumption of risk.
Voluntary Participation: Participation is voluntary and at your own discretion.
Additional Participant Information
Participants Under 18 Years: Participants under 18 years of age must be supervised by a parent, guardian, or responsible adult at all times. Parents, guardians, and supervising adults remain responsible for the care, supervision, and safety of children in their care. Fun Supply does not provide childcare or child supervision services.
Swimming Requirement: All participants confirm they can swim in open ocean conditions for at least 1km, tread water for a minimum of 2 minutes, and will remain within 200m of shore.
